Scanning Services

If you place an order for film or print scanning services you are agreeing to comply with and be bound by the following terms and conditions.

Free trial

Free trial scans and prints are watermarked with the Creative Mode logo and advertising text.

Original materials used for the free trial are returned by standard first class post. Creative Mode will not be held responsible for any loss or damage of original materials in transit.

Delivery

Creative Mode will not be held responsible for any loss or damage of original materials in transit.

Completed orders must be signed for on receipt, please ensure someone is available to receive the order at the delivery address on the delivery date. Any fees incurred by us as a result of undelivered items will be charged to the customer.

Copyright

By agreeing to these terms you are stating that you own or have permission to copy the material provided, and indemnify Creative Mode against any action including copyright infringement.

You will become the owner of your digital images and you shall retain full copyright (or similar rights) in your digital images.

All designs, graphics and other artwork (including the selection and arrangement of text and graphics) is and remains the copyright of Creative Mode, of which any unauthorised use including copying, letting for hire or sale is strictly prohibited.

You are free to make unlimited copies of your digital image archive but you may not copy or reproduce the Creative Mode disc label or DVD box cover or sell any copies you make.

Lost or damaged items

Orders are accepted on the basis that the liability of Creative Mode for any lost or damaged material shall be limited to the replacement with an equivalent amount of new blank stock. This is due to the unavailability of General Insurance cover for work of undefined value.

Right to refuse and refund

We reserve the right to refuse any original materials that appear to be incompatible with or that we believe may cause damage to our hardware.

In cases where we refuse work for technical or compatibility reasons we will issue a refund for each refused item at the full price per item paid. Where the number of refused items is greater than 50% of all order items we shall contact you prior to starting work.

We reserve the right to refuse any original materials that we feel to be of an indecent or illegal nature and contact the relevant authorities.

If you are unsure as to whether your original materials are suitable for scanning please contact us prior to placing your order.

Technical limitations

We respectfully remind customers that the effectiveness of restoration on any slide, film or print is unpredictable, variable and is dependant on many factors including, but not limited to, age, damage, decay, film manufacturer, processing etc.

We will use your chosen scan options whenever possible but not if their use compromises final image quality. We strive to get the best from every single image.

Use of images

We take pride in our work and like to advertise our services with examples from completed orders. We will never use images that appear to be of a sensitive or personal nature.

If you would prefer us not to use your images to advertise our services please state this in the special instructions when you place your order or contact us at any time.

Cancellation

Our scanning services are classed as personalised goods or goods made to a consumer's specification and therefore are exempt from cancellation under the UK Distance Selling Regulations once the service has begun.

The service is deemed to have begun on the date we receive both your original materials and payment. Prior to this you are free to cancel at any time in writing or by email.

If we do not hear from you or receive your original materials and cleared payment within 30 days of your order date we shall consider the order cancelled.

In cases where we receive your original materials but do not receive cleared payment within 30 days of your order date we shall consider the order cancelled. You must arrange for collection of your original materials and cover all collection expenses. If your original materials are not collected from us within 90 days of your order cancellation date they will be destroyed.

Faulty items

We carefully check all discs before an order is dispatched but should a CD or DVD develop a fault due to manufacturing or publishing defects within 12 months of receipt we will issue a free replacement. Please return the faulty disc to us along with a description of the problem and your order number and/or name and address. We will not replace discs that appear to have been physically damaged by mishandling or misuse or that are incompatible with your hardware. This clause does not apply to the free trial.

Refunds

Due to the customised nature of our scanning service we regret we are unable to offer refunds. This does not affect your statutory rights.

If you have concerns about the quality of our work, its suitability for your purposes or the compatability of our discs we recommended you use our Free Trial or contact us before placing a full order.
